Subpoenae and Requests to Examine DHS Case Records

If a social worker receives a request to examine a DHS case record:

  • All requests to examine DHS case records must be referred to the Law Department to evaluate the legal appropriateness of the request.

If a social worker is approached by someone attempting to serve a subpoena for their appearance in court or for a DHS case record:
  • The individual must be directed to go to the Health and Human Services Unit in the Law Department (1515 Arch Street, 16th Floor)
  • A Health and Human Services Unit staff member will contact you to discuss the steps that are required to comply with the subpoena

If a social worker believes that it is necessary to subpoena a person to testify in court:
  • The social worker should contact the city solicitor assigned to that case or the city solicitor who will be handling the list in the courtroom in which the case is scheduled to be heard
  • The Law Department requests at least ten working days to process and serve the subpoena. If this is not possible, the social worker should contact the city solicitor as soon as the witness is identified
