Pre-hearing Conference

A pre-hearing conference is a meeting that is held at Family Court immediately before the first hearing for a case. The pre-hearing conference is scheduled for a specific time.

The purpose of the conference is

  • For the parties to meet
  • To identify needs services for the family
  • To discusses issues involving placement and visitiation

The following individuals must participate in the pre-hearing conference
  • DHS social worker
  • City solicitor and/or legal assistant
  • Parents, legal guardian or legal custodian
  • Attorneys for parents, legal guardian, or legal custodian
  • Child advocate

It may be appropriate for other individuals to participate in the pre-hearing conference, such as
  • Provider agency social worker
  • CASA representative
  • BHS representative
  • Child

A facilitator leads the pre-hearing conference. The parties discuss the facts alleged in the dependent petition, and the issues of placement, visitation and services. The DHS social worker must be prepared to make recommendations for the children’s placement, family visitation (supervised or unsupervised), and social services for the family. Immediately following the pre-hearing conference, the adjudicatory hearing is held.

To prepare for the pre-hearing conference, the DHS social worker must prepare the case with the list attorney assigned to the Courtroom in which the adjudicatory hearing is scheduled to be heard.
