Administrative Appeal Hearing

An administrative appeal hearing is held before a Department of Public Welfare hearing examiner. In most cases, the hearing occurs because a person who DHS determines is a perpetrator of child abuse may challenge that finding. When this occurs, an administrative appeal hearing is scheduled.

Administrative appeal hearings may be scheduled for:

  • Family Service Plan (FSP) appeals,
  • foster home relocation appeals,
  • adoption assistance subsidy appeals, and
  • the timeliness in which an appeal was filed with DPW.

To prepare for this hearing, the DHS social worker who conducted the child abuse investigation, or the DHS social worker who has relevant knowledge about any of the other issues decided at an administrative appeal hearing, must meet with the assigned city solicitor. The social worker should be prepared to suggest names of potential witnesses that may need to be subpoenaed to testify at the administrative appeal hearing. Potential witnesses may include people who have witnessed the child being abused or neglected, police officers, doctors, nurses, or the child. In addition, the city solicitor will help the social worker prepare his or her testimony to ensure an effective, clear and convincing presentation.
